Chapter 1　 General Rules

Article 1 For promoting the healthy development of the cause of the education of

the foreign students in our university and create a fine learning and life environment for them , the following rules and regulations are made in accordance with the Law of the People’s Republic of China on Control of the Entry and Exit of Aliens ,Administrative Rules on the Acceptance of Foreign Students by Colleges and Universities and Rules and Regulations on Disciplinary Punishments for Students in Jinggangshan University (hereinafter referred to as JGSU)and in connection with the actual conditions of foreign students in our university.

 Article 2 These rules and regulations are applicable to the foreign students who study in JGSU.

Article 3 Any foreign student who commits violations whether inside or outside the school during his or her study in JGSU shall be disciplined in accordance with these rules and regulations.

Article 4 In execution of disciplinary actions against foreign students it is necessary to adhere to the principle of combining education with punishment and the principles of fairness, justice and openness, keep due process,sufficient evidence ,clear reference,accurate identification and timely and appropriate punishment and safeguard foreign students’ right of petition.

Chapter 2 Forms and Extent of Application of Disciplinary Punishments

Article 5 Any foreign student who has one of the following cases shall be punished by JGSU:

1.who violates China’s state laws, decrees and regulations

2.who breaks school disciplines

3.who breaches the Standards of Students’Behavior in China’s Institutions of Higher Learning

 Article 6 Disciplinary sanction for foreign students is divided into warning,serious warning,demerit recording ,disciplinary probation and expulsion from school.

Article 7 The person sanctioned shall be subject to the following treatments:

 1.whose selections of outstanding of all kinds and evaluation of scholarship for the current academic year shall be disqualified

2.whose conferring of degree shall be disposed in accordance with the Rules and Regulations for the Implementation of Bachelor’s Degree Awarding for Foreign Students in JGSU.

3.other cases shall be disposed in accordance with relevant provisions

Article 8 The period for disciplinary probation is one year during which time any foreign student who is again subject to school punishment shall be expelled from school.

Artivle 9 Other disciplinary offences which are not included but are subject to punishment shall be dealt with relevant rules and provisions.

Article 10 Any foreign student expelled from school is required to finish school-leaving formalities within a week from the date of the promulgation of the punishment.Any punished foreign student who should refuse to leave school overdue shall be coerced into leave by the International School in collaboration with the Public Security Department and Office of International Cooperation and Exchange of JGSU.

Article 11 Matters concerning foreign udents’disciplinary punishments:

1.A foreign student of the graduating class who should be subject to disciplimary probatin shall receive course-completion.

2.Anyone who has one of the following cases shall be severely punished without exception:

1).who is ill-mannered in fault identity

2).who refuses to mend his or her ways despite repeated disciplinary punishments

3).who has received disciplinary punishment before

4).who heads a group disciplinary offence

5).who hinders managerial staff’s work on purpose

3.Anyone who has one of the following cases shall be lessened his or her disciolinary punishment according to the circumstances.

1).who has taken the initiative to admit his or her fault and has made a deep self-criticism

2).who has positively informed against and disclosed other people’s disciplinary violations

3).who behaves well at ordinary time and is a first offender

4).who has voluntarily taken measures to redeem his or her reputation

4.Foreign students’ disciplinary violations must be stopped all at once , brought into timely investigation and made punishment decisions or suggestions for approval in 5 working days on the basis of ascertaining the facts.

5.Each School should take disciplinary punishments inflicted on the foreign students in a based-on-fact, impartial and reasonable　 way,covering no faults and strictly conforming to the rules and regulations.

6. Documents of decisions of disciplinary punishments inflicted on the foreign students shall be issued by the university.With the exception of privacy and special cases,any punishment above demerit recording shall be published in principle to the whole university and that below demerit recording(including demerit recording) shall be made publicly within the submitting unit.

Chapter 3 Disciplinary Violations and Punishments

Anyone who has one of the following cases shall be expelled from school:

1.who has violated China’s law and constituted a criminal offense

2.who has organized and stirred up troubles or disturbed social and teaching orders

3.who has damaged public property or conducted theft of state,collective or personal belongings , causing heavy loss and damage

4.who has committed thefts and refused to mend his or her ways despite repeated disciplinary punishments or indulged in excessive drinking ,gamble or fight of a serious nature

5.whose absence from class without leave reaches 60 periods or above in one term . (The total periods of a day’s absence from class are calculated according to the actual teaching time and being late for class three times is regarded as absence from class for one period.)

6.who has a ghost examinee or acts as a ghost examinee or has organized cheating in exam,and used communication sets or other means for cheating in exam with a serious nature

7. who has plagiarized or copied other people’s research achievements with a serious nature

8. who has violated the school’rules and regulations and been disciplined repeatedly but knows no repentance after repeated education

9. who has violated the school’other rules and regulations with a serious nature

Article 13 Anyone who violates China’s state law,decrees and regulations ,breaks state criminal law and receives punishment by the Chinese judiciary but

not up to the degree of expulsion from school shall obtain the following punishments respectively:

1.The person who is exempt from criminal punishment or in the security detention due to illegal crime shall receive disciplinary probation.

2.The person who is awarded security warning or public security penalty shall receive demerit recording.

3. The person whose visa or residence permit is overdue shall receive warning or above depending on the seriousness of the case.

Article 14 Any foreign students is strictly forbidden to do missionary work or hold religious party .Otherwise he or she shall receice warning or above.

Article 15 Anyone who holds a demonstration illegally without permission shall receive disciplinary probation or above.

Article 16 Anyone who breaches Law of the People’s Republic of China on Road Traffic Safety and drives a motor vehicle(including motorbikes) illegally shall receive demerit recording and if there is a serious case the person shall receive disciplinary probation or expulsion from school .

Article 17 Trouble-makers and fighters shall receive the following punishments respectively.

1.Peacebreakers

1).The person who doesn’t beat people but incites the fighting shall receive grave warning.

2).The person who beat people but render no injury shall receive demerit recording.

3).The person who causes slight injury to a body or minor wound in fighting shall receive disciplinary probation or expulsion from school.

4).The person who causes severe injury to somebody in fighting shall receive expulsion from school.

5).The person who fights back when taking a beating shall receive warning or grave warning depending on the seriousness of the case.

2.Fighters

1). The person who beats people but renders no injury shall receive warning.

2). The person who causes slight injury to a body or minor wound in fighting shall receive demerit recording or disciplinary probation.

3). The person who causes severe injury to somebody in fighting shall receive expulsion from school.

3.Any participator or accomplice who favors one side in the name of mediation and help so as to worsen the fighting and bring about negative consequences shall receive demerit recording and in case there are severe circumstances, the participator or accomplice shall receive disciplinary recording or expulsion from school.

4.Perjurers

1).Anyone who witnesses the fight but perjures for other people on purpose so as to engender obstacles to investigation shall receive demerit recording or disciplinary probation.

2).Any fighter who infringes the above-mentioned article shall receive disciplinary probation or expulsion from school.

5.Lethal Weapon Providers

1). Any lethal weapon provider who brings about no consequences shall receive demerit recording or disciplinary probation.

 2). Any lethal weapon provider who brings about negative consequences shall receive disciplinary probation or expulsion from school.

6. Anyone who resorts to weapons during the fighting shall receive disciplinary probation or expulsion from school depending on the degree of injury.

7. Anyone who is invited to fight shall receive grave warning or disciplinary probation depending on the seriousness of the case and in case of severe results , shall receive expulsion from school.

8.Anyone who invites other people to fight or draws extraneous persons into the campus for fighting or fight other students off campus shall receive disciplinary probation or expulsion from school.

9.Any instigator who incites other people to fight and brings about negative consequences shall receive demerit recording or disciplinary probation and in case of severe circumstances shall receive expulsion from school.

10.Any articles damaged by fight shall be fully compensated at their market price regardless of their damaged or aging degree and the medical and nutrition expenses shall be paid by the relevant responsibility persons.

Article 18 Any foreign student who smuggles or takes drugs,prostitutes or whores shall receive expulsion from school.

Article 19 Alcoholics and Trouble-making Alcoholics

1.Any alcoholic who brings about negative consequences shall receive warning.

 2.Any trouble-making alcoholic shall receive grave warning or demerit recording.

3.Any alcoholic who gets into fight shall receive disciplinary recording or expulsion from school.

Article 20 Any foreign student who violates the visit rules by lodging a member of opposite sex or an outsider in the dormitory or trespassing on student dormitory in other building shall receive demerit recording or disciplinary probation depending on the seriousness of the case and the consequences . In case a foreign student is late for his or her dormitory at night without reason several times or doesn’t return to his or her dormitory for the whole night without reason and fails to mend his or her ways after education shall receive demerit recording and in case of severe circumstances shall receive disciplinary probation or expulsion from school.

Article 21 Any foreign student who changes his or her dormitory without permission shall receive grave warning and shall receive demerit recording if renting an apartment without the university’s approval.In case there are severe consequences the person shall receive disciplinary probation or expulsion from school.

Article 22 Any foreign student who plays loud sound ,beats percussion instruments or makes big noises in the foreign students’ dormitory or in public places so as to affect the normal life and rest of others shall receive grave warning.

Article 23 Association with opposite sex should be appropriate in words and deeds.Any foreign student whose words and deeds remain indecent in such association shall receive warning or above depending on the seriousness of the case.

Article 24 Anyone who molests or insults a woman or resorts to other hooligan activities shall receive disciplinary probation or above depending on the seriousness of the case.

Article 25 Any foreign student who swims in the river,lake or pool without permission shall receive demerit recording.

Article 26 Foreign students are not permitted to conduct commercial activities in hotels ,bars , nightclubs etc.or shall receive grave warning or above.

Any foreign student who conducts commercial activities without the university’s approval shall receive grave warning or above.

Article 28 Anyone who gambles,steals or extorts private possessions or swindles state,collective or personal properties shall receive the following punishments in accordance with the seriousness of the case and his or her attitude of admission apart from bearing corresponding legal responsibilities and economic compensation .

1. Any foreign student who gambles once shall receive demerit recording.If gambling repeatedly or acting as an organizer of gambling with a grave nature, a foreign student shall receive disciplinary probation or expulsion from school.

2.Any foreign student who commits a crime with its value of less than 100 yuan (RMB) shall receive warning or demerit recording.

3. Any foreign student who commits a crime with its value of 100 to 500 yuan (RMB) shall receive demerit recording.

4. Any foreign student who commits a crime with its value of 500 to 1000 yuan (RMB) shall receive disciplinary probation.

5. Any foreign student who commits a crime with its value of more than 1000 yuan (RMB) shall receive disciplinary probation or expulsion from school.

6.Any foreign student who commits crimes repeatedly and with a grave nature shall receive expulsion from school.

7.Any foreign student who is confirmed to commit a fruitless burglary by the security office or the Public Security Department shall receive demerit recording or disciplinary probation.

8. Any foreign student who harbours stolen things shall receive grave warning or demerit recording.

9. Any foreign student who acts as a gang leader shall be severely punished .

Article 29 Any foreign student who damages public property on purpose shall receive corresponding punishment in accordance with the value of the damaged and the nature and by reference to Article 28 ,apart from relevant compensation for the economic loss.

Article 30 Any foreign student who watches,creats,duplicates,sells,rents or spreads pornographic matters shall receive demerit recording. In case there are severe consequences the foreign student shall receive expulsion from school.

Article 31 Any foreign student who produces , copies or spreads harmful information involved in endangering state security and disturbing social order， or certain filthy information by internet shall receive demerit recording and in case of a grave nature shall receive expulsion from school.

Article 32 Any foreign student who harms the network by embezzling the network account,damaging network equipment ,invading network etc. shall receive demerit recording and in case of a grave nature shall receive expulsion from school.

Article 33 Any Foreign Student who insults or Assault Staff

 1.Any foreign student who insults staff in public shall receive grave warning or demerit recording.

2.Any foreign student who uses violence against staff but inflicts no injury shall receive demerit recording or disciplinary probation . If injury is incurred the foreign student shall receive disciplinary probation or expulsion from school.

Article 34 Any foreign student who is deliberately provocative,intimidates others,strikes something randomly,throws a thing about or smashes it on campus shall receive demerit recording or disciplinary probation .If an injury is incurred by the throw or smash,the foreign student shall receive disciplinary probation or expulsion from school apart from bearing the medical expenses.

Article 35 Any foreign student who spits about,throws waste about, litters up,or scrawls,scribbles ,leaves footsteps or fingerprints about or posts things up against rules and regulations shall receive warning or grave warning.

Article 36 Any foreign student who uses power against rules and regulations,connect the power source without permission ,utilizes high-power electrical appliances or burns litter by open fire in the dormitory shall receive demerit recording and in case of a grave nature shall receive disciplinary probation.

Any foreign student who connects internet in private or sets up unauthorized web agent service shall receive demerit recording.

Article 37 Any foreign student who wastes food,water or electricity and shows no obvious rectification after criticism and education shall receive warning or grave warning.

Article 38 Any foreign student who violates learning disciplines shall receive the following punishments.

1. Any foreign student who violates exam disciplines seriously shall receive demerit recording.

2.Any foreign student who cheats in exam shall receive disciplinary probation.

 3.Any foreign student who cheats seriously shall receive expulsion from school.

4.Any foreign student whose absence from class without leave adds up to the following periods shall receive the following punishments respectively.

1).Any foreign student whose absence from class without leave adds up to 20 to 29 periods shall receive warning .

2). Any foreign student whose absence from class without leave adds up to 30 to 39 periods shall receive grave warning .

 3）. Any foreign student whose absence from class without leave adds up to 40 to 49 periods shall receive demerit recording .

4). Any foreign student whose absence from class without leave adds up to 50 to 59 periods shall receive disciplinary probation .

5). Any foreign student whose absence from class without leave adds up to 60 periods or above shall receive expulsion from school .

5.Any foreign student who violates classroom disciplines and disrupts normal teaching order shall receive grave warning or demerit recording.

6.Any foreign student who plagiarizes or copies others’ research achievements shall receive demerit recording or above in accordance with the seriousness of the case.

Article 39 Any foreign student who offers a bribe to teachers,administrative staff or other personnel shall receive demerit recording or disciplinary probation.And any foreign student who takes a bribe shall receive disciplinary probation or expulsion from school.

Article 40 Any foreign student who breaches public morality shall receive warning or above in accordance with the seriousness of the case

Chapter 4 Approval Procedures

Article 41　 Punishment Decisions and Approval Procedures

1.Warning,grave warning or demerit recording to a foreign student should be suggested in writing by the Student Management Section of the International School ,submitted to International School for verification and to the president or vice president in charge of the International School for approval.

2.Disciplinary probation or expulsion from school should be suggested in writing by the Student Management Section of the International School ,submitted to International School for verification and to the president office of JGSU for approval.

3. Disciplinary punishments for foreign student involved with two or more than two schools shall be suggested at the joint meeting of related schools called by the Department of Student Affairs of JGSU and be correspondingly settled in accordance with 1 and 2 of this article respectively.

4.Any security public cases scrutinized by the Security Office of JGSU　

　and the Public Security Deparment concerned which need to be handled in accordance with the university disciplines shall be submitted to the Security Office for a written punishment opinion and be correspondingly settled in accordance with 1 and 2 of this article respectively.

5.The International School shall post a bulletin on the punishment for violation of learning disciplines on campus for the day.

Article 42 Before making a decision the university should hear the statement and plea of the foreign student or his or her agent and the International School shall be responsible for informing the foreign student of the punishment intention in writing .

Article 43 After making the puninshment decision the university should issue a letter of punishment decision and send at least two persons to deliver it to the foreign student.A letter of decision of expulsion from school should be submitted to the Education Department of Jiangxi Province on file.

Article 44 The university’s decisionon of punishment against a foreign student should include the type,facts ,reasons and grounds of the punishment and the foreign student concerned should be informed of the right of raising an appeal and its date due.

Article 45 A foreign student who has dissent from the punishment decision can put forward a written appeal to the Appealing Committee of JGSU within 5 weekdays after receiving the decision.

Article 46 The Appealing Committee of JGSU shall reexamine the plea ,makes a reexamination decision and inform the plaintiff of the result in 15 working days after receiving the plea.In case there is the need to change the original punishment decision , the Appealing Committee of JGSU shall submit it to the president office for further review .

Article 47 The foreign student who has dissent from the result of review can put forward a written appeal to the Education Department of Jiangxi Province in 15 working days after receiving the review.

Article 48 In case that the foreign student does not put forward any plea within the appeal period from the date of delivery of the decision or review to him or her ,the university shall no longer attend to any appeal by the foreign student.

Article 49　 Approval Procedures of Disciplinary Probation Absolveness

It is required that a foreign student should turn in an application for disciplinary probation absolveness which shall be submitted to the International School for collection after its signature by class committee ,advisor and the Student Management Section of the International School respectively .The university shall issue a document after the approval for the application by the vice president or president in charge of the International School.

Chapter 5　 Supplementary Provisions

Article 50 The Foreign Student Affairs Office shall be responsible for the interpretation of these rules and regulations.
